Reference CLA. Copyright owners have every right to prosecute offenders under the US copyright law. To date there have been a notable number of court decisions against individuals (and organizations) for violations of copyright law–some involving substantial fines.
Protection is available to the following works:
1. “Original works of authorship”, and
2. “Fixed in any tangible medium of expression from which they can be perceived, reproduced, or otherwise communicated.”
“Works of authorship” are listed in #102(a) of the copyright code.
If the three parts to copyright notice are provided as required, then a defense of innocent infringement will probably be unsuccessful.
Question: Are unpublished works also protected under copyright law? Yes. Any work eligible for copyright protection is subject to protection, even though unpublished.

Penalties for Copyright Infringement

The remedies provided by law to a copyright owner means that anyone found making illegal copies, or otherwise infringing, could face the following:
1. Payment of statutory damages from $500.00 to $20,000.00 and, if the court finds willfulness, up to $100,000.00. The court may also allow the recovery of full costs and may reward a reasonable attorney’s fee to the prevailing party.
2. If willful infringement for commercial advantage and private financial gain is proved, fines and/or imprisonment of up to 10 years could be adjudged.
